Council by-election process 

The conduct of Council by-elections is regulated by the Local Government Act 2020 and the Local Government (Electoral) Regulations 2020. The day-to-day management of the by-election process is undertaken by the Victorian Electoral Commission (VEC). 

Darebin City Council Notice of By-Election 

The VEC has published the notice of election for the Darebin City Council By-election, to be held on 2 August 2025. 

Who runs Council elections? 

The VEC is the statutory provider for all Council elections and by-elections. The elections manager will be the Electoral Commissioner or his or her appointee. 

Close of voting 

The by-election will undertaken by postal voting. Ballot papers must be completed and posted to the Elections Manager no later than 6pm on 1 August 2025. 

Key by-election dates will publicised in the lead-up to the by-election, enabling eligible people to participate fully in the process. 

Enrol to vote in the North West Ward by-election

Enrolling to vote 

If you are an Australian citizen aged 18 or over at the time of an election and you live in the North West Ward, you must enrol to vote by 4pm Wednesday 21 May 2025.  

Am I enrolled to vote? 

You are already enrolled to vote if: 

  • You will be 18 years of age or over on election day and 

  • You live in the City of Darebin and are on the Victorian State roll for your current address.

You need to enrol with the VEC for the North West Ward by-election if: 

  • You are an Australian citizen aged 18 or over on election day and 

  • You live in the City of Darebin North West Ward and you are not on the State electoral roll or 

  • You have lived at your present residential address within the North Westy Ward for at least a month and have not updated your enrolment details, including any changes to your postal address 

Enrol online at vec.vic.gov.au or pick up a form at any post office and return it to the Victorian Electoral Commission. 

You may also apply to Council to enrol if you: 

  • are 18 years of age and over on election day and 

  • own a rateable property in the North West Ward of the municipality and you are not enrolled as a non-resident owner and/or non Australian citizen or 

  • pay rates on a property in the North West Ward occupied or lease specifies that you are liable to pay rates (for example, as a shop tenant) or 

  • are appointed by a company that pays rates

Becoming a candidate in the North West Ward by-election

A person may nominate as a candidate for the North West Ward by-election if they are qualified to be an elected Councillor. 

Becoming a Council By-Election candidate 

The by- election for the North West Ward of Darebin City Council will be held on Saturday 2 August 2025.  A person may nominate as a candidate for the by-election if they are qualified to be a Councillor pursuant to section 34 of the Local Government Act 2020 (the Act). 

Qualification to be a Councillor 

(1) A person is qualified to be a Councillor of a Council if the person: 

  • (a) has attained the age of 18 years; and 

  • (b) is an Australian citizen or an eligible British subject referred to in section 48(1)(a) of the Constitution Act 1975; and 

  • (c) is enrolled on the voters' roll for the Council or would be enrolled on the voters' roll for the Council on a particular day if a voters' roll were to be prepared on that particular day; and 

  • (d) is not a person to whom subsection (2) applies. 

Anyone who wishes to nominate as a candidate must also complete compulsory training to help you understand the role and responsibilities of being a councillor. Pursuant to section 256(7) of the Act, a person will not be able to nominate as a candidate unless they have completed the training.  

Non-qualification to be a Councillor 

(2) A person is not qualified to be a Councillor of a Council if the person: 

  • (a) is a member of the Parliament of Victoria or of the Parliament of the Commonwealth of Australia or of another State or a Territory of the Commonwealth; or 

  • (b) is employed as a Ministerial officer, a Parliamentary adviser or an electorate officer by a member of the Parliament of Victoria or in a corresponding position (however designated) by, or for, a member of the Parliament of the Commonwealth of Australia or of another State or a Territory of the Commonwealth; or 

  • (c) is a Councillor of another Council constituted under this Act or a member of a corresponding body (however designated) under an Act of another State or a Territory of the Commonwealth; or 

  • (d) is a member of Council staff of the Council; or 

  • (e) is an undischarged bankrupt; or 

  • (f) has property that is subject to control under the law relating to bankruptcy; or 

  • (g) has failed to take the oath or affirmation of office of Councillor at any Council when required under this Act during the current term of office of that Council; or 

  • (h) has been disqualified from being a Councillor after a finding by VCAT of gross misconduct, for the period that the period of disqualification specified in the order made by VCAT is in force; or 

  • (i) has been subject to 2 or more findings of serious misconduct by a separate Councillor Conduct Panel under section 167 in the preceding 8 years and the period during which the person can apply under section 170 to VCAT for a review of those findings has expired, for the period of 4 years following the second finding of serious misconduct during which the disqualification is in force; or 

  • (j) has been convicted of the offence of failing to lodge an election campaign donation return in relation to the current term of the Council; or 

  • (k) has been convicted of an offence against this Act in the preceding 8 years for which the maximum penalty is at least 120 penalty units or a period of imprisonment of at least 12 months; or 

  • (l) has been convicted of an offence in the preceding 8 years, committed when the person was of or over 18 years of age, which is punishable upon first conviction for a term of imprisonment of 2 years or more under the law of Victoria, or the law of any other State, or a Territory of the Commonwealth, or the law of the Commonwealth; or 

  • (m) is disqualified from managing corporations under Part 2D.6 of the Corporations Act. 

(3) If a Councillor becomes aware that they have ceased to be qualified to be a Councillor of a Council, the Councillor must immediately give notice in writing to the Chief Executive Officer of the Council that they have ceased to be qualified to be a Councillor of the Council.

Do I need to live in the area? 

Candidates must be on Darebin City Council’s voters roll. Candidates can stand for election for any ward within Darebin City Council, even if their enrolled address is in a different ward within the Council. 

Can I have a copy of the electoral roll? 

Candidates will be provided with an electronic copy of Darebin City Council’s electoral roll for the election they are contesting, free of charge. This file can be printed if required and will be in a format suitable for looking up names and mail-merging letters. 

In gaining access to Darebin City Council’s electronic roll, candidates must declare their use of the data is solely for campaign purposes in relation to their election. All copies of the roll provided to candidates must be destroyed after the declaration of result for the by-election or return the copy of the voters’ roll and any copies made from it to the VEC within 30 days after by-election day. Penalties apply for misusing roll information or failing to destroy or return roll information as required.  

How-to-vote cards 

All how-to-vote cards must be registered with the VEC. Any member of the public, candidate or organisation can register a how-to-vote card. 

Am I entitled to public funding? 

There is no public funding for candidates in local Council elections. 

Who can stand as a candidate in the North West Ward by-election? 

To nominate for election as a Councillor, a person must meet the qualification to be a councillor as identified in the “Becoming a Council election candidate” section of this webpage. 

Information and assistance for candidates 

Information and assistance are available in a number of forms prior to and during the by-election. 

VEC 

Before the by-election, the Victorian Electoral Commission usually holds information sessions for prospective candidates. These sessions provide information about the process and enable potential candidates to meet the election manager appointed to run the by-election. Details of information sessions are made available from the Victorian Electoral Commission or from us. 

The Victorian Electoral Commission also provides a comprehensive Candidate Information Kit that describes the by-election process and timelines. The kit also explains the requirements of becoming a candidate and includes forms to be completed by candidates. 

The VEC website contains information about council elections and by-elections, including candidates’ handbooks, which detail the requirements of being a candidate.  

Key election dates 

Candidates for the North West Ward by-election must adhere to certain key dates and conditions. 

  • Entitlement date 
    To stand as a candidate a person needs to be an eligible voter in the City of Darebin no later that 4pm on Wednesday 21 May 2025.  

  • Notice of election 
    The election manager must give public notice of the by-election and call for nominations to fill the vacant position. 

  • Close of nominations 
    Candidates must be nominated by 12 noon on the day that is 39 days before the election day. 

  • Close of voting 
    The election day is the last Saturday in October. Our method of voting is postal voting. Ballot papers must be posted by 6pm on the day before the election day. 

  • Declaration of the poll 
    The election manager will publicly declare results after the votes have been counted and scrutineers have had time to examine the record of the count. The declaration of the election may be delayed if the election manager decides to conduct a recount 

Nominations 

Nominations will open on Monday 16 June 2025 and close at 12 noon on Tuesday 24 June 2025. 

Local Government Victoria mandatory candidate training 

All candidates in any council election or by-election in Victoria are required to complete the online Local Government Candidate Training. All candidates must also declare to the Victorian Electoral Committee (VEC) when they have completed the training in order to nominate. 

The online Candidate Training is available to complete on the Local Government Victoria website and takes around one hour to complete. 

The candidate training – introduced in the Local Government Act 2020 – has been updated by Local Government Victoria to better equip and prepare candidates who are prospective first-term councillors. The training will help candidates understand the role of a councillor and what it requires before nominating. The training also serves as a refresher for more experienced councillors. 

Candidate nominations for council elections will open on Monday 16 June 2025 and close at midday on Tuesday 24 June 2025 – so it’s a good idea for candidates to complete the training before nominations open. 

It is not mandatory for those who have completed Candidate Training in the past two years to complete the training, however, Local Government Victoria strongly recommends that all candidates enrol for the updated training. This will refresh their understanding of the roles and responsibilities of councils and councillors, as well as the standards they are expected to uphold if elected. 

Participants who complete the training will receive a certificate of completion.  

The updated training includes information on: 

  • eligibility requirements for candidates 

  • the role of a council 

  • the role of a councillor, including greater emphasis on the strategic nature of the role and the time commitment required 

  • how councils make decisions 

  • updated information on governance and integrity requirements including personal interest, conflicts of interest, confidentiality, and conduct expected of councillors 

  • support available to help incoming councillors perform their role. 

These topics help ensure that candidates have a better understanding of the role of a councillor prior to standing. 

The updated training complements the reforms introduced in the Local Government Amendment (Governance and Integrity) Act 2024 that introduces the requirement for all councillors to complete professional development training as well as specific training for mayors and deputy mayors.

Campaign donations 

Within 40 days of election day, all candidates must submit to the City of Darebin's Chief Executive Officer an "Election Campaign Donation Return". This will provide details of any gifts, goods or services worth $500 or more, received during the donation period for use in connection with their election campaign. This applies to all candidates, whether elected or not, and whether they received campaign donations or not. 

The ‘donation period’ is defined as the period beginning 30 days after election day in the previous election and ending 30 days after election day in the current election. 

Copies of election donation return forms will be included in candidate information kits and available from us. 

Within 14 days after the deadline for lodgement of completed campaign donation returns by candidates, summaries of each return lodged will be made available on this website for a period up until the entitlement date for the next general election. Completed campaign donation returns are also available for public inspection at the City of Darebin's offices for four years after the election.
